Terms of Use — AI Passenger
These Terms of Use (“Terms”) govern your use of the AI Passenger mobile application and related services (the “App”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. The App and eligibility
AI Passenger provides in-car and on-iPhone experiences—including voice games and roadside assistance features—primarily through Apple CarPlay and your iPhone. You must be able to form a binding contract in your jurisdiction and comply with applicable law. You are responsible for safe operation of your vehicle and device.
2. Bring Your Own Key (BYOK)
The App requires your own Google AI (Gemini) API key. You are solely responsible for obtaining, securing, and complying with Google’s terms for that key. The key is stored on your device as described in our Privacy Policy. PaprikaTech does not sell API credits or charge fees related to your Google API usage.
You must not share your key in ways that violate Google’s policies or expose others to unauthorized use. We may suspend or limit App functionality if we reasonably believe you are misusing the service or violating these Terms.
3. Premium features and purchases
Some features may require a paid subscription processed through Apple’s App Store (and managed via our subscription provider, e.g. RevenueCat). Prices, renewal terms, and refunds are governed by Apple’s payment policies unless otherwise required by law. You can manage or cancel subscriptions in your Apple ID settings.
4. Safe driving and CarPlay
Do not interact with the App in ways that distract from driving. Use CarPlay and voice features only when it is safe and lawful to do so. PaprikaTech is not responsible for accidents, injuries, or violations arising from use of the App while operating a vehicle. Roadside assistance content is informational only and is not emergency services, professional mechanical advice, or a substitute for qualified help.
5. AI-generated content
Responses from the AI model may be inaccurate, incomplete, or inappropriate. You should verify important information (especially vehicle, safety, or legal matters) with qualified sources. PaprikaTech does not guarantee the accuracy or suitability of AI output.
6. Acceptable use
You agree not to:
- Use the App for unlawful, harmful, or abusive purposes
- Attempt to reverse engineer, scrape, or overload the App or connected services except as allowed by law
- Circumvent security, licensing, or subscription requirements
- Upload or elicit content that infringes others’ rights or violates applicable policies
7. Intellectual property
The App, branding, and materials provided by PaprikaTech are owned by PaprikaTech or its licensors and are protected by intellectual property laws. These Terms grant you a limited, non-exclusive, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms and the App Store rules.

Our Privacy Policy explains how we handle information. It is incorporated into these Terms by reference.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAPRIKATECH AND ITS AFFILIATES, OFFICERS, AND EMPLOYEES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US FOR THE APP IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) FIFTY U.S. DOLLARS ($50), EXCEPT WHERE SUCH LIMITATIONS ARE PROHIBITED BY LAW.
11. Indemnity
You agree to indemnify and hold PaprikaTech harmless from claims arising out of your misuse of the App, your API key, your violation of these Terms, or your violation of third-party rights, except to the extent caused by our gross negligence or willful misconduct.
12. Changes
We may update these Terms or the App. We will post revised Terms with a new “Last updated” date. Continued use after changes constitutes acceptance. Material changes may also be communicated through the App or App Store listing where appropriate.
13. Termination
You may stop using the App at any time by uninstalling it. We may suspend or discontinue the App or your access if you breach these Terms or if required for legal or safety reasons.
14. Governing law
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except where mandatory consumer protections in your country of residence apply.
